A Chicago mother is suing McDonald's claiming that her toddler found and ate a used condom at one of its restaurants. She alleges that her 2-year-old son found the condom on the floor of the facility's PlayPlace play area.
The suit was filed by Anishi Spencer at Cook County Circuit Court on Wednesday. Spencer claims that she took her sons, Jacquel, then two years old, and Jonathan, then three years old, to a local McDonald's when the incident occurred.
The two boys were playing in the PlayPlace, the kids' play area, when Jacquel found and ate the condom. He later coughed up a piece of the condom and she took both children to a doctor for medical treatment.
The suit faults McDonald's for its negligence, stating that it should monitor its play areas better to make sure no "deviant activities" are taking place.
As reported by the Huffington Post, a McDonald's representative released a statement.
"Providing a safe, clean environment is a top priority for us. This restaurant is no exception. We take these matters seriously and investigate all claims to gather the facts", said Wanda Haltek, director of operations at McDonalds USA.
McDonald's stated that it will no longer comment on the situation, since the case is now in the hands of the court.
"At the time the lawsuit was filed, we had not completed our investigation and at no time have we given the alleged object in question to examine. Because this is now a pending legal matter, it would be inappropriate to further comment or speculate," said Haltek in the statement.
