Apple has resumed selling Apple Watch Series 9 and Ultra 2 after the company won a court ruling in a patent fight.
Apple Watch Series 9, Ultra 2 Return to Stores
Starting on Thursday noon Pacific Time, the Apple Watch Series 9 and Ultra 2 will resume its online sales after the company was issued a sales and import ban. The Apple smartwatches will also be available again in some physical Apple stores and are expected to have wider availability by Saturday.
"Apple's teams have worked tirelessly over many years to develop technology that empowers users with industry-leading health, wellness, and safety features," a company spokesperson shared in a statement. Apple also shared its gratitude for the decision of the U.S. Court of Appeals.
The ban was lifted after the court allowed Apple to continue selling its watches while waiting for a decision on the proposed changes to the watch that would avoid patent issues. The ruling on the changes is due on January 12.
Masimo Appeals the Suspension of Ban
Apple Watches were pulled out of the website and retail stores last week after the International Trade Commission favored the medical device maker, Masimo. The patent infringement case detailed that Apple used a pair of Masimo patents to measure blood-oxygen saturation on their watches.
Bloomberg reported that Masimo is seeking to intervene in the appeal case. In a separate filing, the medical company argued that the interim should be denied "because there is no emergency."
"Apple fails to inform the Court that it has already stopped sales of the infringing Apple Watches that are the subject of the challenged ITC orders," Masimo stated. If the January ruling is delayed, it could also put the ban on hold for months longer than expected.
