Apple's appeal to ban Samsung's flagship Galaxy S3 smartphone has finally been rejected.
On Monday, U.S. District Judge Lucy Koh in San Jose, California, put an end to Apple's hope to stop Galaxy S3's June 21 launch by denying the injunction, Reuters reported. The fabled Samsung Galaxy S3, however, is one of the biggest Android-based smartphone releases in recent time and put a serious threat to the existing and upcoming iPhones.
Koh claimed that the present Apple case will overload her calendar, as she is also overseeing Apple's high-stakes trial against Samsung that is set to begin in July. The court's verdict is that the Cupertino based tech giant will have to file a fresh request for hearing date from the court to pursue the cause.
"The pending motion for preliminary injunction is fully briefed, and the Court will not consider any further discovery or briefing. An order on the pending motion for preliminary injunction will issue shortly." said Koh. "If Apple seeks to file a motion to enjoin sales of the Samsung Galaxy S III, Apple will have to request a new hearing date from the Court." added Koh.
Samsung said in a statement: "The U.S. District Court for the Northern District of California court rejected Apple's attempt to circumvent the legal process in order to delay the launch of the Galaxy S III. Apple must file a separate preliminary injunction motion, resulting in separate proceedings."
"We will continue to take all available measures to oppose Apple's attempts to disrupt consumer access to the Galaxy S III. We will also ensure that he U.S. launch and sales of the Galaxy S III will proceed as planned."
Seems Apple is going through a rough patch as far as its legal battles are concerned as last Thursday, Judge Richard Posner in Chicago federal court also rejected Apple's long-awaited plea against Google Inc's Motorola Mobility division. The trial was scheduled to start this week.
